وكشفت سابقةُ إحالةِ عدد من القضاة والمحامين الكويتيين إلى المحاكمة في قضية غسيل أموال بالتوازي مع سجن شيوخ من الأسرة الحاكمة متورّطين في قضايا فساد مالي، عن انتباهةٍ كويتية لافتة لخطورة ظاهرة الفساد وعزمٍ على اجتثاثها بعد أن بلغت درجة خطرة من التغوّل والاستشراء داخل أجهزة الدولة وبين مسؤولين يشغلون مواقع حسّاسة.

وأوردت وسائل إعلام كويتية الجمعة أن النيابة العامة الكويتية أحالت إلى محكمة الجنايات ثمانية قضاة ومحاميين هما رجل وامرأة  وستة مسؤولين في محكمتي الكلية والاستئناف في وزارة العدل إلى محكمة الجنايات، وذلك لمحاكمتهم في قضية استغلال الوظيفة والرشوة والتزوير وغسيل الأموال.

وقالت صحيفة الرأي المحلية إنّ من بين المتهمين في القضية رجلي أعمال كويتيين وآخر إيراني.

ويتعلّق الأمر بما بات يُعرف إعلاميا بقضية “شبكة بنيدر” التي تخصّصت في غسيل الأموال وكان يقودها رجل أعمال إيراني مقيم في الكويت وضمّت عددا من الموظفين والمسؤولين الكويتيين من رتب مختلفة بينهم ضبّاط في أجهزة الأمن.

والقضية هي ثالث قضية فساد وغسيل أموال كبيرة تثار في الكويت خلال السنوات الأخيرة إلى جانب كل من قضية “الصندوق الماليزي” وقضية “النائب البنغالي”.

ويجمع بين القضايا الثلاث قاسمان مشتركان يضفيان عليها خطورة استثنائية. ويتمثّل الأول في طابعها العابر لحدود البلاد من خلال تورّط أجانب فيها، بينما يتمثّل الثاني في تواطؤ مسؤولين كويتيين بعضهم رفيعو المستوى في مختلف تلك القضايا الثلاث.

ففي قضية الصندوق الماليزي امتدت عملية غسيل الأموال من الكويت إلى ماليزيا موطن أحد المتّهمين الرئيسيين إلى جزر القمر، حيث يوجد بنك اتّخذ وعاء ماليا للعملية، أمّا أبرز متّهم في القضية فلم يكن سوى ابن رئيس وزراء كويتي سابق مسجون حاليا في قضية فساد منفصلة.

أما قضية النائب البنغالي فكانت عبارة عن شبكة للاتجار بالبشر يقودها نائب في برلمان بنغلاديش وكانت تنشط في جلب وافدين إلى الكويت ومنحهم إقامات في البلاد بطرق غير مشروعة. ومن أبرز المتورّطين إلى جانب النائب البنغالي مسؤوليْن حكومييْن كويتيين سابقيْن ونائب سابق في البرلمان الكويتي ومرشّح سابق للانتخابات البرلمانية.

وقد صدر قبل أيام حكم من محكمة الاستئناف الكويتية بالسجن سبع سنوات وغرامة مالية على المدانين وأبرزهم عضو الأسرة الحاكمة الشيخ مازن الجراح الصباح الوكيل السابق لوزارة الداخلية.

وليست المرّة الأولى التي يرد فيها اسم شيخ كويتي ضمن قضية فساد مالي، حيث تقرّر مؤخرا سجن رئيس الوزراء السابق الشيخ جابر المبارك الحمد الصباح على ذمّة التحقيق في قضية هدر أموال صندوق مخصص للجيش.

ولا تقتصر خطورة تلك القضايا فقط في ضخامة الأموال المنهوبة والمبيّضة وتورّط المسؤولين الكويتيين فيها، ولكن أيضا في طابعها المنظّم وسمتها العابرة للحدود، ما يشكّل خطورة على السمعة الدولية للكويت.

وبشأن إحالة القضاة على المحاكمة قالت صحيفة القبس الكويتية إنّ الأمر يتعلّق بالقضية الثانية من “شبكة بنيدر”، مشيرة إلى أن من ضمن المتهمين ثمانية قضاة ستتم محاكمتهم علنا بعدما تم إيقافهم عن العمل، إلا في حال قررت محكمة الجنايات في جلستها الأولى أن يستمر قرار حظر النشر في القضية.

ونقلت عن مصدر لم تسمّه القول إن هذه القضية مرتبطة بالقضية الأولى للمتهم الإيراني فؤاد صالحي، لافتا إلى أن هناك قاضيين في القضية جرت إحالتهما إلى المجلس التأديبي أما القضاة الثمانية فتقرر إحالتهم إلى المحاكمة. كما أشار إلى أن هناك عددا كبيرا من المتهمين في هذه القضية من بينهم محامٍ ومحامية، بالإضافة إلى مسؤولين في وزارة العدل.

ومثّلت إحالة هؤلاء القضاة إلى المحاكمة سابقة في الكويت جاءت كمؤشّر على تدشين البلد مرحلة من الحزم ضدّ ظاهرة الفساد وجميع المتورّطين فيها دون استثناء.

وجاءت أبلغ رسالة في هذا المجال من خلال قرار محكمة الوزراء مؤخرا حبس رئيس الحكومة السابق الشيخ جابر المبارك الحمد الصباح احتياطيا على ذمة التحقيقات معه في شبهات فساد جرت قبل سنوات في صندوق مالي تابع للجيش.

وعلى الرغم من أنّ التعاطي مع قضية الشيخ جابر يسلك مسارا قضائيا محضا، إلى أنّ متابعين للشأن الكويتي رأوا أنّ الأمر لا يخلو من رسائل سياسية قوية من طاقم الحكم الجديد بقيادة الأمير الشيخ نواف الأحمد الجابر الصباح وولي عهده الشيخ مشعل الأحمد بأنّ عهدهما هو عهد الصرامة مع الفساد. فقد اُعتبر التحقيق مع رئيس الوزراء السابق تلويحا قويا بقبضة القانون من قبل ولي العهد، وبالونَ اختبار لما سيعقب ذلك في تصفية حسابات ومنها حسابات الفساد داخل الأسرة الحاكمة، ومقدّمة لاعتماد مقاربة مماثلة لإجراء اتخذه ولي العهد السعودي الأمير محمد بن سلمان بحق عدد من كبار الأمراء ورجال الأعمال.
